IMPORTANT: PLEASE READ THESE TERMS AND CONDITIONS (THESE “TERMS AND CONDITIONS”) BEFORE ENTERING THE CONTEST. THIS IS A LEGALLY BINDING AGREEMENT BETWEEN YOU AND BLU INC SDN BHD (“BLUINC”) ESTABLISHING THE TERMS AND CONDITIONS UNDER WHICH YOU ARE ENTITLED TO PARTICIPATE IN THE CONTEST.
Organiser: The Contest is organised by BLU INC MEDIA SDN BHD.
This contest is open for all, but you will have to be residing in Malaysia to be eligible for the prizes.
If you are below 18 years of age, you must obtain the appropriate permissions and releases from your parent or legal guardian in order to participate in the Contest.
Employees of the Organiser and its related corporations and their immediate family members.
Employees of any party which is directly involved in organizing, promoting or conducting the Contest.
Employees of external auditors who are directly involved in the Contest.
The Contest period runs from 4 September to 8 October 2017, 11.59pm
To enter the Contest:
1. Cast your votes for your favourite brands in the respective categories; and
2. Accept these Terms & Conditions by clicking to agree on the Terms & Conditions and submitting the form.
3. Referring a friend to participate in the voting increases your chances of winning.
Selected winners will be notified via phone for grand prizes, and post for consolation prizes. Response must be given within FIVE (5) working days from such notification or prizes will be deemed forfeited.
Selected registrants must furnish either his/her passport or identity card for verification purposes when collecting his/her prize.
How prize winner will be selected:
Grand Prize: Claude Bernard watch (worth RM885.10) and a L’Occitane hamper (worth RM1,000)
2nd Prize: Claude Bernard watch (worth RM885.10), a laptop messenger bag (worth RM350) and a hamper (worth RM350)
3rd Prize: Claude Bernard watch (worth RM885.10) and a laptop messenger bag (worth RM350)
4th – 6th Prizes: Claude Bernard watch (worth RM885.10) and 1-year cloud backup subscription
2x Consolation Prizes: Claude Bernard watch (worth RM832.10)
How prize winner will be notified:
The prize winner will be notified by post, email or phone, and the results of the Contest will be published online latest by end of December 2017.
If the prize remains unclaimed ONE (1) month after the prize winner has been announced and notified, it will be forfeited and disposed of by the Organiser in its sole and absolute discretion.
Claiming a prize:
The prize collection details can be found in the mail which will be sent to the prize winner. Further information/instructions will be provided in the mail as well.
Taxes, etc.: Taxes and other levies imposed by any relevant applicable government or tax authority, as well as other costs including insurance and incidental costs, that may be levied or incurred on the prizes shall be fully borne by the prize winner.
Promotional activities: By participating in the Contest, except where prohibited by law, you consent to the use of your name, photo and/or likeness, video and voice recordings, biographical information, Contest entry (if applicable) and statements attributed to you (if true) for publicity, marketing, advertising and promotional purposes without limitation in any manner whatsoever and in any part of the world as the Organiser shall in its sole discretion deem fit without any compensation or notice to you.
Limitation of liability; Indemnity: To the maximum extent permitted by law, The Organiser and its parent company, affiliates, related corporations, subsidiaries, directors, officers, employees and agents accepts no responsibility whatsoever for any damage, loss, death or personal injury that may occur as a consequence of your participation in the Contest. You undertake to indemnify and keep the Organiser and its parent company, affiliates, related corporations, subsidiaries, directors, officers, employees and agents harmless and indemnified against any loss, damage, claims, costs and expenses which may be incurred or suffered by any or each of them due to your breach of any of these Terms and Conditions and/or arising from your participation in the Contest.
The Organiser’s decision final and binding: In the event of any dispute arising from the Contest or relating to the interpretation of these Terms and Conditions, the decision of the Organiser on all matters pertaining to the Contest shall be final and binding on all parties. No correspondence will be entertained.
Privacy. The information submitted by you during the registration process or otherwise when participating in the Contest may include your email address, ID number and other personal information (“Personal Information”). Except as provided elsewhere in these Terms and Conditions, your Personal Information will only be used by the Organiser for the purposes of administering your participation in the Contest.
No use of unlicensed software. You declare and warrant to the Organiser that in participating in the Contest, you shall not use any unauthorised or unlicensed software. This includes tampering with the submission or modifying using these software. If you are found doing so, you shall be disqualified from the Contest.
The Organiser’s IP rights not affected: Nothing in the Contest shall affect any intellectual property rights of the Organiser in any product or service which may be the subject matter of the Contest.
No cheating tolerated: Nothing in the Contest shall affect any intellectual property rights of the Organiser in any product or service which may be the subject matter of the Contest.
No waiver: The Organiser’s failure to enforce any provision of these Terms and Conditions shall not constitute a waiver of that or of any other provision.
Modification of these Terms and Conditions, etc.: The Organiser may modify these Terms and Conditions and/or withdraw or terminate the Contest at any stage without any liability towards anyone.
Laws: The Contest shall be governed by and interpreted in accordance with the laws of Malaysia. The Contest is void where prohibited or restricted by law, and is subject to all applicable laws.
No third party rights: A person who is not a party to this agreement shall not have any rights under the Contracts (Rights of Third Parties) Act (Cap. 53B) to enforce any of its terms. For the purposes of this paragraph, “person” shall mean a human being or a corporate entity (whether or not having a separate legal personality), as the case may be.
